This Telehealth Consent (“Consent”) applies to services obtained from the Professional Entities set forth in the Blue Haven RX Terms and Conditions, a brand of Eternum Health LLC (“Company,” “we,” or “our”).

Telehealth allows healthcare providers to assess and treat patients remotely using technology. This may involve transmitting medical records, photographs, and other personal and health information through various methods, including digital intake forms, secure messaging, and telephone or video communication. The electronic systems used to deliver the Services incorporate network and software security protocols designed to protect the privacy and security of your information.

The Services are delivered primarily on an asynchronous (“store-and-forward”) basis, in which you submit information through a digital intake and a licensed healthcare provider reviews and responds to that information without a real-time interaction. In states where applicable law requires it, or where your treating provider determines it is clinically appropriate, the Services are delivered synchronously by telephone.

Possible benefits of telehealth: Telehealth allows you to interact with your provider at times and locations convenient for you, without the need for an in-office appointment.

Possible risks of telehealth: Telehealth services are not a substitute for ongoing, in-person care from a local healthcare provider. Due to the limitations of remote care, including the absence of complete medical records and the inability to perform physical examinations, certain risks are associated with telehealth.

To support accurate evaluation and appropriate treatment, you must provide a comprehensive and truthful medical history, including all diagnoses, treatments, prior and current medications, supplements, allergies, and pregnancy or breastfeeding status. Failure to disclose complete and accurate information may result in misdiagnosis, inappropriate treatment, denial of care, or adverse outcomes.

Your provider may recommend alternative care or in-person consultation with a local healthcare provider, and may decline to issue a prescription or other treatment based on the limitations of telehealth or in their independent professional judgment.

Technical or internet disruptions, such as poor audio quality, dropped calls, or service interruptions, may cause delays in evaluation, consultation, or treatment. If you experience technical difficulties, please contact your provider or Blue Haven RX customer support.

Telehealth is not suitable for all medical situations, particularly emergencies or allergic or other adverse reactions. In such cases, contact your local healthcare provider or proceed to an emergency room. For medical emergencies, dial 911.

While security protocols are in place, there is a residual risk of privacy breaches and unauthorized disclosure of your health information.

State laws may restrict or prohibit telehealth services, including the prescribing of certain medications, in your area.

Your Consent to Telehealth

By using the Services, you acknowledge and agree to the following regarding telehealth services provided by the Professional Entities.

Provider Qualifications and Service Limitations:

  • Healthcare services are delivered via telehealth.
  • Your provider may be a physician, nurse practitioner, or physician assistant, in each case licensed in your state.
  • You consent to evaluation, treatment, and prescribing (where appropriate) by any of these provider types.
  • Telehealth is an evolving field, and the technology used to deliver the Services may change over time and may differ from what is described here.
  • No specific outcome, including any specific weight loss or response to treatment, is guaranteed. Your condition may not improve, and may worsen.
  • Telehealth is not suitable for all conditions.

Your Understanding and Responsibilities:

  • You have considered the benefits and risks of telehealth and understand the alternatives, including in-person care.
  • Your provider will assess your condition and determine, in their sole clinical judgment, whether telehealth is appropriate for you.
  • By using the Services, you agree with your provider’s assessment and consent to telehealth treatment.
  • You agree to provide accurate and complete medical information, including information from other healthcare providers, and accurate emergency contact information.
  • You understand that failure to provide accurate information could negatively impact your treatment.
  • Your provider may determine that your condition requires in-person treatment.

Consent and Withdrawal:

  • You may withdraw this Consent at any time by providing written notice to your provider.
  • Withdrawal will not affect care, treatment, or other actions taken before your notice is received, and will not affect any other provisions of this Consent.
  • Your continued use of the Services constitutes ongoing consent to receive treatment via telehealth.

Electronic Communication and Privacy:

  • The Services involve electronic communication of your personal and health information.
  • Your information will be handled in accordance with applicable privacy policies, including the Blue Haven RX Privacy Policy and the applicable Notice of Privacy Practices of the Professional Entities.

Financial Considerations:

  • You may obtain medical examinations from other healthcare providers at your own expense.
  • Prescriptions issued through the Services will be filled by our pharmacy partners and shipped to you.
  • You are responsible for all costs associated with the Services, including prescriptions, and you agree that you will not seek reimbursement from Medicare, Medicaid, TRICARE, or any other federal healthcare program for any portion of the Services or any prescription issued in connection with the Services.
